These general terms and conditions set out the rights and obligations of the parties when purchasing from the gazebo-altanky.sk online shop, operated by Gazebo s.r.o.
Introductory provisions and the seller
The seller is Gazebo s.r.o., with its registered office at Ružová dolina 4145/6, 940 56 Nové Zámky, reg. no. 53 258 185, VAT ID: SK2121338362, registered in the Commercial Register [TO ADD: court, section and insert number]. Contact: altanky@gazebo-altanky.sk, +421 907 260 142.
These general terms and conditions form an integral part of the purchase contract concluded between the seller and the buyer through the gazebo-altanky.sk online shop and have been drawn up in accordance with the laws of the Slovak Republic.
Definitions
Seller – Gazebo s.r.o.
Buyer – a natural or legal person who submits an order through the online shop.
Consumer – a natural person who, when concluding and performing the contract, is not acting within the scope of their business activity.
Goods – the products offered in the online shop, including items custom-made to the buyer's configuration.
Orders and conclusion of the purchase contract
The buyer creates an order by selecting the goods and their configuration, completing the order form and submitting it. A submitted order is a proposal to conclude a purchase contract.
The purchase contract is formed when the seller confirms the order, which the seller sends to the email address provided by the buyer. Before submitting an order, the buyer is required to read these terms and conditions and confirm their agreement with them.
Prices and payment terms
All prices shown in the online shop are contractual and are stated excluding VAT. The seller is a VAT payer.
The buyer may pay for the goods by card through the secure Stripe payment gateway. [TO ADD: other payment methods, e.g. bank transfer, if available.]
The seller will issue a tax document (invoice) once the price has been paid and send it to the buyer.
Delivery terms
We deliver and install goods throughout the Slovak Republic. As most products are custom-made, the seller agrees the specific delivery and installation date with the buyer once the order has been confirmed. [TO ADD: indicative delivery times and any transport/installation costs.]
The risk of damage to the goods passes to the buyer upon taking delivery of the goods.
Withdrawal from the contract
Under Act No. 102/2014 Coll., a consumer has the right to withdraw from a distance contract without giving a reason within 14 days of taking delivery of the goods. Notice of withdrawal must be sent in writing to the seller's registered office or by email; the model form provided below may be used.
However, a consumer may not withdraw from a contract for the sale of goods made to the consumer's specific requirements, custom-made goods, or goods intended specifically for one consumer (Section 7(6)(c) of Act No. 102/2014 Coll.). As pergolas, gazebos and other products are custom-made to the buyer's configuration, the right of withdrawal does not apply to such goods.
If a consumer validly withdraws from the contract, the seller will refund the payments received within 14 days using the same means of payment that was used, unless the parties agree otherwise.
Complaints procedure and liability for defects
The seller is liable for defects the goods have on delivery and for defects that arise during the warranty period. The warranty period is 24 months, unless the law provides otherwise, and begins when the buyer takes delivery of the goods.
The buyer submits a complaint to the seller in writing at the registered office or by email to altanky@gazebo-altanky.sk. The complaint should state the buyer's details, a description of the defect and the remedy sought. The seller will issue confirmation that a complaint has been made and will resolve it within 30 days of it being made at the latest.
The warranty does not cover defects caused by normal wear and tear, improper use, incorrect handling or unauthorised interference by the buyer.
Alternative dispute resolution
A consumer has the right to contact the seller with a request for redress if they are dissatisfied with the way a complaint has been handled or believe the seller has breached their rights. If the seller rejects the request, or fails to respond within 30 days, the consumer has the right to submit a proposal to begin alternative dispute resolution.
The competent body for alternative dispute resolution is the Slovak Trade Inspection (www.soi.sk) or another authorised legal entity listed by the Ministry of Economy of the Slovak Republic. Consumers may also use the ODR (online dispute resolution) platform available at https://ec.europa.eu/consumers/odr.

Final provisions
These terms and conditions take effect on the date of publication. The seller reserves the right to amend them at any time; the terms and conditions in effect at the time an order is submitted apply to that particular order.
Legal relationships not governed by these terms and conditions are governed by the relevant provisions of the Civil Code, Act No. 250/2007 Coll. on consumer protection and Act No. 102/2014 Coll.
